First intro to Copyright perils and intricacies…one month into VAE research.

Derek, good day.

I’ve just begun researching the airline my father founded in 1945 –

Veterans Airline. Today, via GenealogyBank.com, in The Weekly Kansas

City Star, Missouri Edition, I found a 2-page, feature article with

photo about the company’s second contract flight to Warsaw in 1946 with

a cargo for UNRRA of hatching eggs. (Unbelievably, the flight take off

on May 20. That was 69 years ago to the day.)

This article contains incredible details about a story my Dad told me

repeatedly throughout his life. And it has given me names of two crew

members I had not discovered yet, plus confirmed another crew member.

In short, the article is a treasure and I would like reprint permission.

At the moment, that would entail credited excerpts of the story and, if

possible, permission to reprint the photo & caption, on my research

website — www.VeteransAir.org . I’d be very happy to just use a

copy/paste of the image/caption directly from the PDF I now have of the

article. Something like below. I don’t expect the paper has an image

going back to 1946.

At the moment, Derek, I’m doing this research for myself. Long-term, I

don’t know if there is enough material out there for me to eventually

publish something. Way too soon to tell, and way too many details to

chase down. But today’s find sure is encouraging.

Here are the full details on the article:

Missouri Edition: June 5 1946

Drops Into Poland To Find Eerie World of Armed Men

Written by Don M. Turnbull, who was actually on the flight and pictured

above.

Pages 1 & 2

I’m about to add a POST about the story to my website. I’m much too

excited at the “find” not to share it immediately. Without your

permission, excerpts & the photo will never appear. My sincere wish is

that I will be granted permission. I understand a fee would be likely.

That’s fine. If you wish to contact me, either via this email or by

phone is convenient.

My best,

Be delighted. It is in two pieces – page 1 and page 2 – and, as you’ll

see, what I captured is the entire newspaper page. I didn’t know how

else to do it.

Thanks for such a quick reply, Derek!

OK, thank you. Unfortunately, I can’t grant permission, as The Star

didn’t generate this copy or the photo. You can quote from it and

probably would be OK to reproduce the photo as long as you make clear

where it originally ran. But be aware that if you ran the text in full

and the Turnbull estate found it and wanted to pursue a copyright claim,

they’d likely have a case.

Copyright on issues such as this can be very complicated. Again, best to

quote and excerpt under what constitutes fair use.

Derek, that’s perfect. It’s a long article and, as interesting and

insightful as the story is, much doesn’t pertain directly to my

research. I will excerpt gingerly and with full credit. And I will be

explicit in revealing my source of the photograph.

Thank you so very much for your swift assistance. In addition, I

appreciate the clear statement of pitfalls and of my responsibility.

You’re definitely within fair use parameters there, Gaye. Thanks for

letting me know.
